Please read the following terms and conditions carefully.

About the Program

Participants ("Participants", "Customer" or "you") whose applications to participate in the Smartsavings Program ("Program") are accepted by SmartSavings and who fully comply with these official terms and conditions ("Terms") will receive a reward from SmartSavings.

Why should I participate in the Program?

If you are deemed eligible to participate in the Program, as set forth below in the "Eligibility Requirements" section and otherwise described in these Terms, the Program will enable municipal utility providers to help customers save money while also allowing municipal utilities and SmartSavings to evaluate energy savings achieved as a result of the Program. By participating in the Program, Participants will also help reduce the risk of blackouts and brownouts occurring in their electricity service areas. By accepting this Agreement, Participants are aware that energy and monetary savings are an estimate, not a guarantee that any individual user will save energy.

Binding Agreement

To participate in the Program and in addition to any other requirements described below, Participants must be at least 18 years of age and agree to these Terms. Because these Terms form a legally binding agreement with respect to the Program, please read them carefully. These Terms apply to your participation in the Program. If you do not agree to these Terms, you are not eligible to participate in the Program. Your application for the Program or your written acceptance thereof constitutes your agreement to these Terms. Notwithstanding the foregoing, you will not become a "Participant" in the Program until your application has been accepted and approved by SmartSavings and your municipal utility provider. These Terms become effective upon acceptance and will continue until you, SmartSavings, or your municipal utility provider cancels or terminates your participation, provided that any permissions or releases granted hereunder shall survive cancellation or termination with respect to activities occurring prior to the time of such cancellation or termination.

Eligibility Requirements

The SmartSavings Program is available to residential customers who meet certain eligibility requirements. In order to participate, you must be a residential account holder with a participating municipal utility provider, with an installed, operable and communicating smart thermostat controlling an air conditioner at the eligible service address. Eligibility criteria for inclusion in the Program includes that the customer:

  • Is at least 18 years of age.
  • Has a service account in good standing with a participating municipal utility provider.
  • Has an installed, qualified smart thermostat, connected to Wi-Fi, controlling a central A/C unit.
  • Agrees to the terms and conditions set forth in this Agreement.

Upon your agreeing to the Terms of this Agreement, SmartSavings will contact your utility provider to verify your account eligibility and to enroll you into Program.


Participants are eligible to earn a signup bonus of $60 upon full enrollment, and $20 annually for each year of participation. SmartSavings and your municipal utility provider reserve the right to seek further information to verify your eligibility to receive the Reward.

Program Participation

Under this service, the SmartSavings Program servers will remotely inform your smart thermostat of the existence of Community Energy Hours, causing the thermostat to change the temperature setpoint for the air conditioner in your home on that day. At any time that you desire, you may override this temperature setpoint simply by turning your smart thermostat to a different temperature or using your mobile/Web client. Your agreement below gives SmartSavings permission to enable Community Energy Hours and collect your information for program participation purposes, and for the SmartSavings team to enroll you in the SmartSavings Program.

By submitting this Agreement, you agree and certify that:

  • The information you have provided as part of this Agreement is truthful and you believe you meet the minimum eligibility criteria above.
  • SmartSavings may terminate your Agreement and not enroll you in the Program if you are not truthful in the information you submit as part of this Agreement, if you do not satisfy eligibility requirements, or for any other reason, at any time. You are participating in the SmartSavings Program on a voluntary basis.
  • During your participation in the Program, SmartSavings servers may remotely inform your smart thermostat to implement a change in the temperature set-point for the air conditioner in your home during Community Energy Hours. This adjustment will occur without any manual intervention by you. Community Energy Hours occur on any day of the week between May 1 and September 30.
  • You release and hold harmless SmartSavings from any liability, claim, demand, cause of action, damage or expense resulting from your participation in the Program, or the release and use of your information obtained and managed as described in this Agreement.

This Agreement is effective upon your submitting your application to enroll in the SmartSavings Program and will continue until you, SmartSavings, or your municipal utility provider terminates this Agreement or otherwise cancels your participation.

*Google Nest Rush Hour Rewards programming is from May 1 through September 30.

Authorization to Receive Customer Information

I authorize SmartSavings to act as my agent in connection with my participation in the Program. SmartSavings will provide eligibility information back to Virtual Peaker for your service account.

Authorization is given for the period commencing with the date of execution until I cancel this authorization by providing notice to SmartSavings by unenrolling from the Program.

SmartSavings will provide the eligibility information requested above to Virtual Peaker, to the extent available, at no charge to me.

I declare under penalty of perjury under the laws of the state of my service address that I am the customer of record for the service account provided.

I certify that SmartSavings has authority to act on my behalf and request the release of information for the account listed above and perform the specific acts and functions listed above.

I understand that my municipal utility provider reserves the right, but has no obligation, to verify any authorization request submitted before releasing information or taking any action on my behalf.

I authorize my municipal utility provider to release the confirmation of eligibility on my account to SmartSavings, who is acting on my behalf regarding the matters listed above.

I hereby release, hold harmless, and indemnify my municipal utility provider from any liability, claims, demands, cause of action, damages, or expenses resulting from: 

  1. Any release of information to SmartSavings pursuant to this Authorization;
  2. The unauthorized use of this information by SmartSavings;
  3. From any actions taken by SmartSavings pursuant to this authorization.
